Ms. Sreyasree Chowdhury ...for Petitioners Sk. Md. Masud ...for the State A report is filed in terms of previous order dated 26th February, 2025 on behalf of District Inspector of Schools (S.E.), Bankura dated 7th March, 2025 and same is taken on record.

Petitioners are the legal heirs of an approved Assistant Teacher of a Government aided school claiming interest on delayed payment of gratuity due to death of the teacher in-harness on 1st August, 2019.

On perusal of the report and the writ petition, it appears that pension payment order was issued on 16th October, 2023 and apparently it appears that there was delay in releasing gratuity in favour of the legal heirs of the deceased teacher. However, it appears from the report of the District Inspector of Schools (S.E.), Bankura that petitioner no.1 finally forwarded the soft copy of the application as well as hard copy before the school authority on 28th September, 2023 and there was considerable delay in submitting pension papers. It further appears that pension papers were submitted before the school authority on 28th September, 2023 and pension payment order was issued on 16th

October, 2023. Therefore, it appears delay is not attributable to the State authorities.

Hence, writ petition stands dismissed.

There shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
