Bijoy Adhikary v. The State Of West Bengal
02.01.2025 sdas Rejected C.R.M. (A) No. 4680 of 2024 In Re:- An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita in connection with Chatterjeehat Police Station Case No. 168 of 2024 dated 25.08.2024 under Sections 498A/370/506/34 of the Indian Penal Code read with Sections 4/5 of the Immoral Traffic (Prevention) Act.
And In Re : Bijoy Adhikary ..... petitioner Mr. Sabyasachi Chatterjee Mr. Aniruddha Bhattacharyya Mr. Uttam Mukherjee Ms. Anushka Bose .....for the petitioner Mr. Atif Ahmed Siddiqui ..... for the State Mr. Joydeep Das Mr. Bhola Nath Ghoshal ..... for the de facto complainant 1.
Learned Counsel for the petitioner submits he is the husband of the de facto complaint-wife. There is matrimonial dispute. As a result he along with other in-laws have been falsely implicated. Allegation of trafficking the wife is out and out false and patently absurd. Parents-in-law i.e. coaccused have been granted anticipatory bail. Accordingly, he prays for similar relief.
2.
Learned Counsel for the State opposes the prayer for anticipatory bail.
3.
Learned Counsel for the de facto complainant also opposes the prayer for anticipatory bail.
4.
We have considered the materials on record including statement of the de facto complainant. She has alleged petitioner i.e. her husband had sold her for sexual exploitation. Her statement does not implicate other in-laws in the said act. Petitioner does not stand on the same footing with the co-accused who have granted anticipatory bail. 5.
In view of the gravity of offence and prima facie involvement of the petitioner, we are not inclined to grant anticipatory bail to the petitioner.
6. Accordingly, prayer for anticipatory bail is rejected. (Shampa Dutt (Paul), J.) (Joymalya Bagchi, J.)
