05.02.2025 05.02.2025 Ct. No. 28 (ARPAN) (REJECTED) C.R.M. (A) 126 of 2025 In Re: An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kaliganj Police Station Case No.182 of 2024 dated 24.02.2024 under Sections 341/323/325/307/506/34 of the IPC and under Section 4 of POCSO Act And In Re: Neighbour of the victim girl ... Petitioner Ms. Karabi Roy ...for the Petitioner Mr. Binoy Kumar Panda Mr. Debanik Das ...for the State 1.
Petitioner renews his prayer for pre-arrest bail. It is contended investigation is complete and the principal accused has been released on bail.
2.
We have considered the materials on record. Earlier prayer of pre-arrest bail was rejected on merits. Statement of the victim implicates the petitioner in the crime. Submission of charge-sheet is an aggravating and not a mitigating circumstance. Grant of bail to co-accused is also not relevant as the parameter for grant of prearrest bail is significantly different from that of regular bail. Hence, we are not inclined to grant anticipatory bail. 3.
Officer-in-charge shall submit explanation why steps were not taken to apprehend the petitioner notwithstanding earlier rejection of pre-arrest bail. Report be filed within one (1) week. 4.
The application for anticipatory bail is, thus, rejected.
