At the time of hearing, learned advocate for the writ petitioner draws attention of this Court to Page No. 24 of the instant writ petition being a copy of the letter dated 29.08.2024 as written by the writ petitioner addressed to the respondent no.

5/authority requesting him to shift the 'Bhagar' which is situated at R.S. Plot No. 805, L.R. Plot No. 851, Mouza - Naikuri Jagannathchalk, District - Purba Medinipur and the said land according to the petitioner is owned and possessed by the respondent no. 6/authority.

It is the grievance of the writ petitioner that despite submission of representation, the respondent no. 5/authority has not considered such representation in accordance with law.

Mr. De, learned Additional Government Pleader appearing on behalf of the respondent/State and its functionaries though disputed the contention of the learned advocate for the writ petitioner, however, in his usual fairness, he submits that the appropriate

authority may be directed to consider the representation in accordance with law.

In view of such while disposing the instant writ petition, this Court directs the respondent no. 5/authority to consider the representation dated 29.08.2024 as submitted by the writ petitioner in accordance with law and after giving an opportunity of hearing to the writ petitioner and/or his authorized representative(s) shall pass a reasoned order and shall forthwith communicate his reasoned order to the writ petitioner preferably by mail, if the mail details of the writ petitioner are provided to him at the time of hearing.

The entire exercise as indicated in the foregoing paragraphs is to be completed within 45 working days from the date of communication of the server copy of this order.

Liberty is given to the learned advocate on record for the writ petitioner to communicate the server copy of this order along with a copy of the instant writ petition to the respondent no. 4/authority for his due compliance.

The respondent no. 4/authority is hereby directed to act on the server copy of this order.

Before parting with, it is made clear that the time limit as fixed by this Court is mandatory and preemptory. 9.

With the aforementioned observation, the instant writ petition being WPA 31054 of 2024 is disposed of.

10. Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
