Report submitted by the learned advocate appearing for the State be also kept with the record. Learned advocate appearing for the petitioners submits that in connection with Title Suit No. 391/2024, an injunction order has been passed. However, in view of the said injunction order not being effected, the petitioners have preferred an application under Section 151 of the Code of Civil Procedure before the learned Civil Judge (Jr. Division), 2nd Court, Sealdah. The said application is for rendering appropriate police assistance by Beniapukur Police Station.

In view of the application under Section 151 of the Code of Civil Procedure pending before the jurisdictional civil court, I direct that in case the

court decides to exercise its discretion, the police authorities would respect and obey such order. The police authorities in the meantime would keep a strict vigil and only ensure that no breach of the peace or tranquility takes place.

With the aforesaid observations, the writ petition being WPA 50 of 2025 is disposed of. As no affidavits have been called for, the accusations made against the private respondents and/or the State-respondents are deemed not to have been admitted.

There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
