This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Senior Division), Kakdwip, South 24 Parganas to dispose of the Title Suit No.136 of 2019 expeditiously. In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite parties. However, the learned advocate appearing for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or upon the learned advocates representing them before the learned Trial Court. From the order-sheet appended to this revisional application, this Court finds that December 5, 2024 was fixed for filing of the written statement by the defendant nos.14, 17, 30 and 34 and for service return upon the defendant nos.4, 15, 16, 19, 28 and 29. The learned advocate for the petitioner could not satisfy this Court that the summons have been duly

served upon the defendant nos.4, 15, 16, 19, 28 and 29.

From the order-sheet appended to this revisional application, it is evident that the suit is not yet ready for hearing.

For such reason, this Court is not inclined to pass any direction for expeditious hearing of the suit at this stage.

With the aforesaid observation, C. O. No. 4501 of 2024 stands disposed of.
