This is an application praying for direction upon the respondent authorities to revoke and cancel the notice dated 20.08.2010 issued by the respondent no.6.
Learned counsel appearing on behalf of the petitioners submits as follows. A meeting was held between the petitioners and the respondent no.2 on 13.09.2022 regarding settlement of the issues between the parties which have become the subject matter of the present writ petition. In the said meeting, it was decided that the petitioners would withdraw the Court case on the next date of hearing and after withdrawal, the corporation will reinstate the petitioners in possession of the plot of land in question. Thereafter, the petitioners have to come up with an application in the form of DPR and timeline of schedule of activities within two weeks from the date of the meeting. It has
been further agreed that if the proposal is not satisfactory as per point of view of WBSIDCL and if the petitioners delayed in submitting the proposal, the corporation would have the right to reassume the possession of the land in question. The petitioners were to submit the undertaking in the form of an affidavit. An affidavit to such effect has already been submitted by the petitioners. In view of the above, the petitioners would like to withdraw the writ petition without prejudice to the rights of the parties and subject to the terms and conditions agreed between the private parties. A copy of the affidavit along with the minutes of the meeting are attached with the letter issued by the petitioners to the learned counsel for the corporation, which is taken on record.
Learned senior counsel appearing on behalf of the petitioners submits that the petitioners would have to come up with a viable proposal and the corporation would do its bit in giving effect to the minutes of the meeting.
I have heard the learned counsels appearing on behalf of the parties and perused the petition and the documents filed in Court on behalf of the petitioners.
On the prayer of the learned counsel appearing for the petitioners and without prejudice to the rights of the parties, the writ petition is dismissed as withdrawn.
