Siddique, Mr. Nilotpal Chatterjee ..for the State This public interest petition was filed in the year 2014 with a prayer to direct the official respondents to withdraw police personnel and member of the security and investigating agency from Makhra Primary School and to ensure that the regular educational activities are restored in the school and there is no hindrance for children in pursuing their studies in the school. The above petition was filed in the background of the fact that at that time there was law and order situation in the village as 250 people armed with deadly weapons and explosives had entered the village resulting in massacre of several villagers and in that process one child, namely, Tausif had also died. To maintain law and order the police personnel had occupied Makhra Primary School and the allegation was that on account of the same the school was practically closed down.

This Court by order dated 30th of January, 2015

had directed the respondent authorities to ensure that they shift the police camp from Makhra Primary School Campus to a different place.

The report in the form of affidavit has been filed by the official respondent today disclosing that thereafter the police camp was made ready with tin shed and police personnel staying in the school in question was shifting in that police camp.

Learned counsel for the State has informed that now the entire school premises is free from any interference by the police personnel and that the school is running regularly in the usual manner.

Having regard to the subsequent development, we are of the opinion that the grievance raised by the petitioners does not survive. Hence, we dismiss the petition, however, with liberty to the petitioners to approach this Court again, in case if any such eventuality arises in future.
