This is an application under Section 5 of the Limitation Act wherein the petitioner has prayed for condonation of delay of 443 days in filing the present application for recalling the order dated 13th December, 2022, by which this court was pleased to dismiss the application on the ground of default.

Upon hearing of learned counsel for the petitioner and the grounds shown in the application, the prayer for condonation of delay in filing the restoration application is allowed. CRAN 2 of 2024 is accordingly disposed of.

Re: CRAN 1 of 2024 This is an application wherein the petitioner has prayed for recalling the order dated 13th December, 2022, by which this court was pleased to dismiss the application on the ground of default.

Having heard the learned counsel for the petitioner and the grounds shown in the application, the prayer for restoration is allowed.

Let CRR 3559 of 2013 be restored in its original file with original number.

CRAN 1 of 2024 is accordingly disposed of.

Petitioner is directed to serve a notice of restoration upon the opposite party intimating the next date of hearing and to file affidavit of service on the returnable date.
