On the file being sent by the department, this matter was placed in the list. It is running in the list for several weeks and has been called on from time to time.

No one has ever responded when the matter has been called on. The matter, therefor, was placed in the list with the note "First Chance". No one responded even at this stage. Then the matter appeared in the list marked as "Last Chance". Despite being called on several times when the matter appeared in the list marked as "Last Chance", no one appeared.

It appears that the petitioner no.1 having failed to deposit the contribution was hauled up by the Employees Provident Fund Organisation (in short, EPFO) challenging a claim of Rs.10,74,596.70, this writ petition was filed in the year 2008.

It further appears that with the passage of time the writ petition has become infructuous and as

such, the petitioners are not interested to prosecute the matter.

The application is, therefor, disposed of without any order.
