Mr. Sanatan Panja ... for the State The writ petition was assigned by the Hon'ble Chief Justice vide order dated 19th September, 2023 to me accordingly matter is taken up for consideration today in presence of the learned advocates representing the petitioner and the State respondents.
On hearing the parties and on perusal of records it appears that the writ petition was disposed of vide order dated 18th July, 2022 passed by the Hon'ble Justice Rajasekhar Mantha. After disposal of the writ petition it was pointed out by the learned advocate representing the petitioner before the Hon'ble Justice Rajasekhar Mantha on 21st July, 2022 that certain errors crept in the order dated 18th July, 2022 and the Court vide order dated 21st July, 2022 observed that the same may be considered if an application for modification is filed seeking modification of the said order dated 18th July, 2022. Subsequently, two modification applications were filed one being CAN 2 of 2023 which was preferred by the Director of Pension,
Provident Fund and Group Insurance and another being CAN 1 of 2022 by the petitioner.
Since the writ petition was disposed of vide order dated 18th July, 2022 and in both the applications being CAN 1 of 2022 and CAN 2 of 2023 respective applicants are seeking modification of the said order dated 18th July, 2022, these two applications are released from my list and be placed before the Hon'ble Chief Justice for appropriate order.
