The instant criminal revisional application is pending since 2012 and as such is required to be disposed of. The instant revisional application has been filed for taking cognizance by the learned Judicial Magistrate, 2nd Court, Jangipur in complaint case no. CR 776 of 2011 vide order dated 1st October, 2011. The petitioner has filed the instant petition at an early stage. Despite service of notice none of the parties are present before the learned trial court to dispose of the revisional application as expeditiously as possible.

The contention of the petitioner as well as the copy of the complaint reveals the dispute between the parties to be civil in nature whereby the de facto complainant had failed to repay the instalment of loan obtained from the petitioner company and owing to a difference thereof, the instant complaint had been filed. The trial court needs to adduce evidence in order to unravel the veracity of the complaint through proper process. Under such circumstances the revisional application being CRR 4144 of 2012 is dismissed.
