Mondal ...For the contemnors The present contempt application has been filed alleging violation of order dated 12th March 2019, whereby the respondents were directed to give permanent appointment to the writ petitioner with effect from the date of affirmation of the writ application, i.e., 12th November 2014.

It is submitted that despite the fact that salary was directed to be paid prospectively, with effect from the date of the petitioner's joining, however, fixation of salary was directed to be made with effect from 12th November 2014 that is on the basis of the date of appointment. It is submitted that the respondents did not permit the petitioner to join. His salary has also not been refixed.

Mr. Deb Roy, learned AGP submits that challenging the aforesaid order dated 12th March 2019, an appeal has been filed. He, however, candidly

submits that the delay in filing the appeal is yet to be condoned.

In reply, Mr. Sarkar, learned advocate appearing for the applicant submits that till date, no copy of the appeal or connected application has been served on the applicant.

Having heard the respective submissions on behalf of the respective parties, I am of the view that since the respondents have preferred an appeal in the matter, let this mater stand adjourned for 6 weeks. Since it is submitted on behalf of the applicant that the applicant has already reached the age of superannuation, it is expected that the respondents shall take expeditious steps in the aforesaid appeal.
