The writ petition is taken up for consideration in presence of Mr. Bari, learned advocate representing the petitioner. However, no one is representing the West Bengal Central School Service Commission and State respondents today. Mr. Bari, has submitted that in the writ petition order dated 4th October, 2008 passed by the Secretary, West Bengal Regional School Service Commission (W.R), Bankura, respondent no. 4, is under challenge.

Mr. Bari, has tried to defend the case of the petitioner and has submitted that the order passed by the respondent no. 4 is improper.

This Court has perused the order dated 4th October, 2008 passed by the respondent no. 4 wherefrom it appears that petitioner participated for being appointed in the post of Assistant Teacher in Chemistry (Hons/PG) in 6th RLST (A.T) 2005 as physically handicapped candidate. Such offering of candidature of the petitioner was based on Physically Handicapped Certificate dated 16th September, 1993. It appears from the decision of

the respondent no. 4 dated 4th October, 2008 that the candidature of the petitioner was cancelled since petitioner failed to renew such physically handicapped certificate after the same was issued on 16th September, 1993 within the prescribed time which prevented the concerned authority of the Commission to treat the petitioner as physically handicapped candidate in the said selection process.

In view of aforesaid position, this Court does not find any flaw in the order passed by the respondent no.

Accordingly, writ petition stands dismissed.

However, there shall be no order as to costs. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
