Learned counsel for the respondent no.1 is present and brings the notice of this court to the order of transfer (Page 82) which has been challenged by the writ petitioner. The said order is dated 13th December, 2012. Vide the said order the petitioner was transferred from Kolkata to Guwahati. It is now submitted that the petitioner has retired from service on 31st July, 2013 on superannuation and as such the writ petitioner has become infructuous.

Considering the fact that the petitioner has not appeared since the date of listing, the writ petition is dismissed for default.

WPA 27638 of 2012 is accordingly disposed of. There will be no order as to costs.

All connected applications, if any, stand disposed of.

Interim order, if any, stands vacated.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties expeditiously after due compliance.
