... For the State The petitioner contended that she is an Assistant Teacher in Zoology (Science Group) of Sripur High School (H.S.), District - Burdwan. The petitioner was appointed following the Regional Level Selection Test for appointment of Assistant Teacher held in 2008. The recommendation of the petitioner was made on August 17, 2009. She had joined the post and started teaching since July 3, 1999. The petitioner had qualified the Doctorate degree in Zoology (Ph.D.) on August 26, 2008. The petitioner contended that she was all along, after acquiring the said Doctorate degree, eligible to get the necessary and consequential increments which were denied to the petitioner. Despite repeated requests, the same were not acceded to by the relevant State authorities.

After hearing the learned counsel appearing for the parties and on perusal of records it appears that justice

will be subserved at this stage by directing the relevant authority to consider the case of the petitioner and to come to a conclusion with a reasoned order.

Mr. Mukherjee, learned Additional Government Pleader submits that the second respondent, The Commissioner of School Education, Secondary Education, Government of West Bengal is the appropriate authority.

In view of the above, the second respondent is directed to consider the representation of the petitioner treating a copy of this writ petition along with all its annexures to be the comprehensive representation after affording an opportunity of hearing to the petitioner in accordance with law and shall dispose of the representation with a reasoned order.

The petitioner must be given at least one week prior hearing notice. The petitioner can present her case either by herself or through her authorised representative. The entire exercise, as directed above, must be carried out by the second respondent within a period of six week from the date of communication of this order. The second respondent then forthwith communicate the reasoned order to the petitioner within a further period of two weeks from the date of delivery of the reasoned order to be passed.

On the above terms, the writ petition, WPA 30346 of 2014 stands disposed of.

There will be no order as to costs.
