This application under Section 482 of Cr.P.C. has been filed by the petitioner for quashment of proceeding of Burrabazar P.S. Case No. 396 dated 06.10.2012 corresponding to G.R. No. 2956/12 under Sections 418/420/406 of the Indian Penal Code. Upon perusal of record, I find that the petitioner, who has been arraigned as an accused person was directed to appear before the Investigating Officer who would not take any coercive measure against the petitioner. Such order was passed on 17.04.2013.

Record suggests there is no development whatsoever. When police registered a case and decided to proceed with the investigation of the same, there is hardly any reason to throttle such investigation. As there was no order of stay, there is every reason to presume that by this time the police has completed investigation and submitted a report in final form either in the shape of F.R.T. or charge-sheet.

The petition merits no consideration and is dismissed without any order as to costs.

The interim order, if any, stands vacated.

Let a copy of the order be sent to the learned Trial Court for information and necessary action.
