Present writ petition has been filed by the writ petitioner challenging the order dated November 19, 2012 passed by the West Bengal Administrative Tribunal (for short 'the Tribunal').

The reason recorded in the impugned order passed by the Tribunal shows that the petitioner had secured 77.825 marks in total which included marks obtained by him in written examination and interview, whereas the last selected candidate had secured 77.875 marks. As the petitioner had secured marks less than the last selected candidate, we do not find any error in the order passed by the Tribunal, whereby his claim for a direction to the respondents to select and appoint him, was rejected. Merely on the basis of higher marks secured in the written examination, he

WPST 459 of 2012 could not seek selection, once marks obtained in interview were also to be added for preparation of final merit list.

The writ petition is accordingly dismissed.
