Sheela Biswas @ Shila Biswas v. Bina Paul

This revisional application challenges the order dated 30th April, 2013 passed by the learned Additional District Judge, 1st Court, Krishnagar, Nadia whereby direction was given to deposit a sum of Rs. 50,000/- towards court fees in a proceeding under Section 276 of the Indian Succession Act.

The application under consideration was earlier dismissed for default on 2nd December, 2014 and on 30th September, 2015 it was restored to its original file.

The learned trial court directed the plaintiff in the original Suit No.12 of 2001 to deposit a sum of Rs. 50,000/- in terms of the amended provision of the Court Fees Act.

The order impugned does not suffer from any perversity or jurisdictional error.

The revisional application merits no consideration and is dismissed, however, without cost.

Let a copy of this order be sent down to the learned trial court forthwith.
