18.06.2021 Court No.34 In Re: - An application under Section 401 read with Section 482 of the Code of Criminal Procedure;

And In Re: - Utpal Roy Petitioner The records of the case reflect that on 24.07.2014 lastly the interim order was extended for a period of one week after reopening of the Court after long Puja Vacation of the year 2014. Thereafter the said interim order has never been extended before this court.

When the matter has been taken up today, none appeared on behalf of the petitioner and I find that the issue relates to execution case arising out of a proceeding under Section 125 of the Code of Criminal Procedure. As no information has been furnished before this court regarding the status of the proceeding as on date and there was no interim order for a period of more than six years, I am of the view that no useful purpose will be served by keeping the revisional application pending before this court. Learned Magistrate is directed that in case the execution case is still pending and there are arrears due, the same should be disposed of in accordance with law within a period of four weeks from the date of communication of this order. The revisional application as such calls for no interference from this court.

With the aforesaid directions CRR 3796 of 2013 is

disposed of. All connected applications are also deemed to be disposed of accordingly.
