Learned advocate appearing for the petitioner submits that the petitioner was appointed as an Associate Professor in Chandidas Mahavidyalaya, Khujutipara, Birbhum.

By referring the Annexure P/1 at page 18 of this writ petition, learned advocate appearing for the petitioner submits that he was appointed with effect from July 15, 1976, but his retiral dues were released treating him to be appointed on 01.12.1980.

Mr. Sandip Kumar Bhattacharyya, learned advocate appearing for the Principal Accountant General (A & E ) submits that his retiral dues have been calculated from December 1, 1980, the date from which service of the petitioner was confirmed.

This Court is not in a position to ascertain the facts in absence of the State.

It appears that the petitioner had made a representation before the Joint Director of Public Instruction, Government of West Bengal as long back on April 1, 2013, seeking revision of his retiral dues contending that he was appointed against a sanctioned post on July 15, 1976.

I dispose of this writ petition giving a direction upon the Director of Public Instruction to consider the said representation as appearing at page 35 within a period of two months from the date of communication of this order.

The Director of Public Instruction shall hear the petitioner and the representative of Chandidas Mahavidyalaya before passing such order. The decision shall be communicated to the petitioner within two weeks thereafter.

Accordingly, W.P.A. 31906 of 2014 is disposed of.
