Mr. Arijit Bardhan, learned advocate appearing on behalf of the petitioner submits that he is unable to contact with his client in spite of repeated attempts.

The matter is pending since 2013. It is the duty of the of the petitioner to maintain contact with her lawyer atleast once in a year. The circumstances indicate that the petitioner has lost her interest in pursuing the present application.

C.O. 3947 of 2013 is, therefore, dismissed for non-prosecution without any order as to costs. Interim order passed earlier stands vacated.

The department is directed to communicate this order to the Court of learned Additional District Judge, Barrackpore, District 24-Parganas (North) where the matrimonial suit being Matrimonial Suit No. 1275 of 2012 sought to be withdrawn and transferred by the present application is pending. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
