This is an application praying for recalling the order of dismissal dated 05.09.2016.

It reveals that by an order dated 07.03.2019 while disposing CAN 952 of 2016 the said order of dismissal dated 05.09.2016 was recalled and the instant writ petition was restored to its original file.

Such being the position, CAN 1 of 2016 (Old No. CAN 9952 of 2016) has become infructuous and is thus disposed of.

Department is directed not to show pendency of the CAN 1 of 2016 (Old No. CAN 9952 of 2016) during the next listing of this case.

Learned Advocate for the respondent nos. 2 and 3 files his affidavit-in-opposition. Let the same be taken on record.
