The petitioner is aggrieved by the order dated 15th February, 2010 passed by the District Inspector of Schools (SE) rejecting his prayer for higher scale of pay. The facts of the case are that the petitioner was appointed on 2005 on the recommendation of the School Service Commission as an Assistant Teacher in Geography in a pass graduate post. For appointment to such pass graduate post the only a pass graduate degree is necessary.

The petitioner already had a master degree prior thereto. The petitioner thereafter sat in the examination for honours post of Assistant Teacher and succeeded. He started getting Honours/PG scale in the new post from November 2013.

The petitioner thereafter sought the graduate scale of pay for the period from 13th May, 2005 till

26.11.2013. The District Inspector of Schools found that for working in the pass graduate post the only requirement is a pass graduate degree and, hence, the petitioner was not entitled to the post-graduate scale of pay since the pass graduate post in which he worked earlier does not require a post graduate degree in the first place.

There is some doubt as to whether the petitioner having a Master Degree could have at all applied for post-graduate scale of pay.

Be that as it may, this Court does not find any infirmity in the impugned order dated 15th February, 2010.

W.P.A. No.32586 of 2014 is therefore dismissed. There shall be no order as to costs.
