Sumitra Kujur v. State Of West Bengal & ORS.
03.08.2023 Ct. No. 11 rrc WPA 35761 of 2013 (Sumitra Kujur Vs. The State of West Bengal & Ors.) Praying for a direction upon the respondent to appoint the petitioner as ASHA in the sub-center of Banial Unit within No. 11 Gofanagar Gram Panchayat, District - Dakshin Dinajpur, this writ petition was preferred.
The facts projected in the writ petition are that in 2009 one selection process was initiated to fill up the posts of ASHA. The petitioner participated in the selection process and was selected under ST Category and even her name was forwarded with a recommendation to appoint her in the post, but no step has been taken on the basis of such recommendation and subsequently in 2013, another selection process was initiated for filling up the said posts and hence, she made representation but her representation has not been attended to. Aggrieved thereby, the writ petitioner has been constrained to approach this Court.
The first selection process was initiated in way back in 2010 whereas the second selection process was initiated in 2013.
I am of the view that with the passage of time, the writ petition has become infructuous.
In view thereof, the writ petition is disposed of. There shall, however, be no order as to costs. Interim order, if any, stands vacated.
