The application is yet to be served upon the respondents. That apart, learned advocate appearing for the writ petitioner is unable to assist us on the merits either of the main matter or of the application for restoration.

In such circumstances, we are unable to allow the prayer in the restoration application although, we remind ourselves that Court needs to be lenient while considering such application.

The conduct of the writ petitioner does not allow us to take a lenient view. Strategic restoration should not be countenanced.

C.A.N.2 of 2023 is dismissed.
