Application for recalling has been filed on 15th December, 2023 and thus within time.

Considering the grounds as stated and in the interest of justice, the order dated 16.11.2023 is hereby recalled.

WPA 33699 of 2014 is restored to its file and number.

IA No.: CAN 2 of 2023 is accordingly disposed of.

Learned counsel for the petitioner submits that an interim order was in force prior to the dismissal of the writ petition and prays for its revival and extension.

Learned counsel for the Regional Provident Fund Commissioner is present and strongly objects to the prayer for revival of the interim order. But considering the nature of relief prayed for in the writ application, let the interim order be revived in the interest of justice and extended till 21st May, 2025, or until further order whichever is earlier.

Matter be fixed for final hearing in the monthly list of May, 2025.

Parties are at liberty to file a short note of argument along with the judgements relied upon, if any, on the next date of hearing.
