Rupali Dhara & ORS v. State Of West Bengal & ORS

03.08.2023 Ct. No. 11 rrc WPA 37176 of 2013 (Rupali Dhara & Ors. Vs. The State of West Bengal & Ors.) This writ petition was preferred seeking a direction upon the respondents to withdraw and/or cancel the order dated 21st November, 2013 filed by the Child Development Project Officer concerned and to appoint the petitioner in the post of Anganwari Helper. In 2009, one selection process was initiated to fill up the post of Anganwari Helper. But no panel was finalized and approved by the selection committee. In 2003, the composition of selection committee was changed and the essential qualification for the post was enhanced from Class-VIII to Class-X and on the basis of new norms and/or policy, a new selection process was commenced and concluded. The petitioner is a Class-VIII passed candidate and according to new policy, she is not entitled to be appointed in the post of Anganwari helper.

Considering this aspect of the matter, this Court is of the view that no interference is called for in the writ petition.

Accordingly, the writ petition is, thus, dismissed. There shall, however, be no order as to costs. (Partha Sarathi Chatterjee, J.)
