22.09.2021 Item no.72 Ct. No.39 CHC C.R.R. No.3960 of 2014 IA NO: CRAN/1/2015 (Old No:CRAN/1507/2015) CRAN/2/2015 (Old No:CRAN/3167/2015) CRAN/3/2017 (Old No:CRAN/5248/2017) (Physical Hearing) In Re:- A petition under Sections 397/401 read with Section 482 of the Code of Criminal Procedure, 1973.

AND In the matter of:- Manish Agarwal & ors.

.....petitioners Mr. Anirban Dutta, Ms. Pallabi Ghosh ...for the petitioners Mr. Y. J. Dastoor, Ld. A.S.G.

Mr. Phiroze Edulji, Mr. Samrat Goswami ...for the C.B.I.

Parties are represented by their learned advocates, names of whom are shown at the beginning of this ordersheet. Xerox copy of the order furnished by the petitioner passed in Special Case No.10 of 2010 be taken on record. Mr. Anirban Dutta, learned advocate representing the petitioners submits that Special Case No.10 of 2010 pending before the learned Special Judge, C.B.I. Court, at Alipore, under Section 13(2) read with Section 13(1)(d) of Prevention and Corruption Act, 1988 has already been concluded resulting in

acquittal for petitioners after full trial, meaning thereby three petitioners involved in this revisional application have been acquitted in the trial, held by the learned Special Judge, C.B.I. Court.

Mr. Edulji, learned advocate being led by Mr. Y. J. Dastoor, learned Additional Solicitor General submits that Special Case No.10 of 2010 arises out of R.C. Case No.08 of 2009. Mr. Edulji is fair enough to submit that he has nothing to say, when the trial has been concluded and the petitioners have been favoured with acquittal.

It is, thus, clear that the instant revisional application has become infructuous. Nothing remains in this case requiring any decision.

The instant revisional application being C.R.R.3960 of 2014 stands disposed of.

Department is directed to send copy of this order to the learned court below within a week from this date for necessary information.
