(Through Video Conference) Ms. Chandreyi Alam ... ... for the Union of India In this petition the petitioner has sought a direction to the respondent nos. 4 and 6 to take steps in respect of alleged illegal acts and activities of the BSF personnel upon the villagers of Village - Bijoypur within P.S. - Krishnagung in the District - Nadia.

Having perused the writ petition, we have noticed that apart from mentioning the two old incidents of 8th August, and the other reflected in the representation dated 20th September, 2014 only general allegations have been made without any specific particulars.

Affidavit-in-opposition on behalf of the respondent nos. 1 to 4 and 6 discloses the incident of 8th August, 2014 relates to smuggling of cattle from India to Bangladesh and the other reflected in the representation dated 20th September, 2014 was found to be baseless as some miscreants of Village - Bijoypur were trying to tarnish the image of BSF in order to continue their nefarious, anti-national activities including smuggling of cattle heads and other contraband items from India to Bangladesh.

All other allegations have been denied in the affidavit-in-opposition.

No exception or affidavit-in-reply has been filed till now. The petition is pending since 2014 and more than seven years have passed and today, no one is present to prosecute this petition.

Hence, we find no justification to keep this petition pending.

Having regard to the plea taken by the respondents in their affidavit-in-opposition, we are of the opinion that no case for issuing any direction in the present petition is made out, the petition is accordingly dismissed. (Prakash Shrivastava, C.J.) (Rajarshi Bharadwaj, J.)
