None appeared for the petitioner when the matter was last taken up for hearing on November 9, 2022. The Distribution Licensee is consistently represented through counsel, who had filed his affidavit-in-opposition on the last hearing date.

Despite the time for filing affidavit-in-reply being extended suo moto on November 9, 2022, the petitioner has neither filed such reply nor is being represented consistently when the matter is taken up for hearing.

Accordingly, WPA No. 38116 of 2013 is dismissed for default without any order as to costs.
