Patra, learned advocate representing the Commission has submitted on instruction before this Court that the petitioner who participated in 12th RLST 2011 for appointment in the post of Assistant Teacher ranked 945 in the merit list and under the same category last candidate who has been favoured with appointment ranked 910.
Accordingly, it appears that the petitioner did not come within the zone of consideration in the said selection process as a result whereof recommendation could not be made for appointment of the petitioner.
Mr. Kartick Chandra Kapas, learned advocate representing the petitioner has submitted that candidates who ranked below the petitioner in the merit list were
considered for recommendation for being appointed in the post of Assistant Teacher ignoring the merit position of the petitioner. However, it appears from the writ petition that no such case has been made out on supersession indicating particulars of the candidates who got benefit of such supersesssion Another issue which appears to this Court is very relevant in deciding this writ petition is fact of expiry of panel on 24th March, 2015 which was prepared after conducting 12th Regional Level Selection Test 2011. Meanwhile, 7 (seven) years have passed.
Accordingly, the writ petition stands dismissed. However, there shall be no order as to costs. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (Saugata Bhattacharyya, J.)
