The present application under Section 439 of the code of Criminal Procedure has been preferred by the petitioners in connection with Gaighata P.S. Case No. 854 of 2013 dated 16.11.2013 under Sections 13/14 of the Foreigners Act. Records reflect that lastly the matter appeared on 16.01.2014 and the matter was directed to go out of list for want of determination. As the application for bail is pending for more than seven years and none has pursued the matter before this Court for such long period, I am of the view that the present bail application has become infructuous. Accordingly, the application for bail, being CRM 16724 of 2013, is dismissed as infructuous.
