This appeal is arising out of a judgment and order dated 5th April, 1997 passed by the learned 3rd Bench, City Civil Court, Calcutta in Title Suit No. 922 of 1997 passed in connection with an application for temporary injunction under Order XXXIX Rules 1 and 2 read with Section 151 of the Code of Civil Procedure.

In the suit, the appellant has challenged the order of transfer. The learned Judge although not recorded in detail the prima facie opinion to restrain the respondent from transferring the appellant granted limited order of injunction from 5th April, 1997 till 26th April, 1997.

Considering the nature of the order and duration for which such ad interim order was passed, we are not inclined to admit the appeal.

The appeal stands dismissed. However, there shall be no order as to costs.
