23.09.2022 Item No.02 Court No.32 Avijit Mitra RVW 113 of 2018 with IA No.CAN 1 of 2018 (Old No. CAN 6641 of 2018) (not found) with IA No.CAN 2 of 2022 (not found) in WPST No.41 of 2015 State of West Bengal & ors.

- Versus - Anukul Barman & ors.

Mr. Sirsanyo Bandyopadhyay Mr. Arka Kumar Nag ...for the applicants Mr. Debabrata Acharyya, Mr. Sk. Samsul Arefin, Mr. Sital Samanta ...for the respondent nos.1 to 8 Aggrieved by the judgment dated 30th August, 2017 passed in WPST No.41 of 2015, the State West Bengal and its functionaries have preferred the present review application, being RVW 113 of 2018.

Mr. Bandyopadhyay, learned advocate appearing for the applicant submits that in connection with the review, an application for stay being IA No.CAN 1 of 2018 (Old No. CAN 6641 of 2018) has been filed along with an application for condonation of delay being IA No.CAN 2 of 2022.

As we have invited Mr. Bandyopadhyay to advance his argument on merits of the review application, we condone the delay and allow the application for

condonation of delay being IA No. CAN 2 of 2022 upon treating the same as on day's list.

Heard Mr. Bandyopadhyay, learned advocate appearing for the applicant and Mr. Acharyya, learned advocate appearing for the respondent nos. 1 to 8. Records would reveal that six writ petitions were dismissed by a common judgment dated 30th August, 2017. Against the same judgment passed in WPST No.68 of 2015 the State and its functionaries preferred a review application. Upon contested hearing the said review application was dismissed by an order dated 26th April, 2022.

As no fresh issue has been argued by Mr. Bandyopadhyay, we are of the opinion that no interference is called for in the present review application. In view thereof, the review application being RVW 113 of 2018 and the connected application being IA No.CAN 1 of 2018 (Old No. CAN 6641 of 2018) are dismissed.

All parties shall act on the server copies of this order duly downloaded from the official website of this Court.
