1. Pursuant to the order dated 12.08.2024, notice was served upon the respondent nos. 1, 3 and 4. The respondent nos. 1, 3 and 4 do not turn up either in-person or through their learned advocates.

2. A report is received that the respondent no. 2, i.e., Bankim Dehuri is no more in the earth.

3. In view of such, the instant appeal stands abated as against the respondent no. 2, Bankim Dehuri.

4. Further report has been received to the effect that the appellant, Pratap Chandra Nanda had died on 16.08.2004.

5. In view of such death of the appellant, the instant appeal also stands abated as against the present appellant, Pratap Chandra Nanda and is thus disposed of.

6. Department is directed to send down the LCR along with a copy of this order to the learned trial Court.

7. Department is further directed to send down the Appeal Court Record to the first appellate court along with another copy of this order.
