(Via Video Conference) In spite of notice served upon the appellant No.3, the said appellant is not represented. The appellant Nos.1 and 2 died during the pendency of the appeal and no attempt was made to file any application for substitution. The appeal is pending since 1995 for admission.

In view of the fact that the second appeal has abated insofar as the appellant Nos.1 and 2 are concerned and having regard to the nature of the decree, the second appeal stands dismissed as abated as a whole.

The learned Registrar Administration (L&OM) is directed to communicate this order to the learned Civil Judge (Junior Division), 2nd Court, Contai in connection with Title Suit No.46 of 1988 for information and doing the needful.
