Nirmal Kumar Manna v. State Of West Bengal & ORS
07.03.2022 Item No.27 Court No.6.
S. De Through Video Conference R.V.W. 53 of 2020 Nirmal Kumar Manna.
Vs The State of West Bengal & Ors.
IA No. CAN/1/2021 Mr. Sandipan Pal, ...for the applicant.
Ms. Sukla Das Chanda, ...for the State.
In re: IA No. CAN/1/2021 This is an application for condonation of delay of 1849 days in filing the application for review. Though we are not satisfied with the explanation for such huge delay, for the ends of justice the delay is condoned. IA No. CAN 1 of 2021 is, accordingly, disposed of.
In re : R.V.W. 53 of 2020 By filing this application an order dated January 19, 2015, is sought to be reviewed.
By the said order a Co-ordinate Bench of this Court disposed of the application being W.P.S.T. No.10 of 2015 (Nirmal Kumar Manna Vs. The State of West Bengal & Ors.) without interfering with an order of the West Bengal State Administrative Tribunal since the name of the review applicant had already been
empanelled in the land loser category for his employment in future.
Learned advocate appearing in support of the review application submits that the applicant is 52 years old as on date and as such there is no scope for his public employment, and his son may be empanelled in his place.
We do not find it to be a ground for reiview of the order dated January 19, 2015.
This review application being R.V.W. 53 of 2020 is accordingly dismissed. However, the applicant will be at liberty to make appropriate representation before the respondent authorities for redressal of his grievances.
Urgent certified photostat copy of this order, if applied for, shall be given to the parties upon compliance with all the necessary formalities. (Kausik Chanda, J.) (Arijit Banerjee, J.)
