4. In pursuance of the direction, a report is submitted by the Superintendent of Police, Krishnanagar Police District. Let it be taken on record.
5. This instant appeal is preferred at the behest of the appellant/complainant challenging the impugned judgment and order of acquittal dated 19.06.1992 passed by the learned Trial Court in connection with Case No. 316C of 1988.
6. Being aggrieved by and dissatisfied with the said impugned judgment and order, the present appeal is preferred at the behest of the appellant/complainant.
7. It appears from the report submitted by the Chief Judicial Magistrate, Nadia that during pendency of this appeal, the appellant, Aruneswaar Roy, died on 27.11.2005. The said report indicates that the respondent/accused no. 1, Biswanath Saha, also died on 16.12.2019.
8. As the respondent no. 1, Biswanath Saha, has already been died, the instant appeal stands abated against him.
9. I perused the impugned judgment and order passed by the learned Trial Court dated 19.06.1992 and I find nothing material to interfere with the said impugned judgment and order.
10. Accordingly, the instant appeal be and the same is hereby dismissed on merit.
11. Let a copy of this order along with TCR be sent down to the learned Trial Court immediately.
12. Urgent photostat certified copy of the order, if applied for, be given to the parties upon complying with all legal formalities. (Prasenjit Biswas, J.)
