And In the matter of:- Khokon Aram @ Khokon Arat @ Arong @ Arokh @ Dipankar Arong & ors.

Petitioners Mr. Kanai Lal Mondal .. for the petitioners Ms. Faria Hossain, Mr. Aniket Mitra ..for the State Case Dairy placed before us and from the materials also placed in the petition, it appears that the parties are the covillagers and during scuffle both sides sustained injuries. In fact the petitioners here filed a written complaint on 9.7.2020. To that effect a document has been annexed which shows that they also sustained injuries. Case Dairy which has been placed before us has been perused and reveals minor injuries over the person of the complainant.

Having regard to such nature of the injury and the case and counter case filed by the petitioner and the accused persons we are of the opinion that the custodial interrogation of the petitioners are not necessary.

We, therefore, direct that in the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties, one of whom must be local, to the satisfaction of the arresting officer and on condition that except female members (petitioners), other male members (petitioners) shall meet the investigating officer once in a fortnight.

The aforesaid conditions are in addition to the provisions of Section 438(2) of the Code of Criminal Procedure. With these observations, CRM 6451 of 2020 and CRAN 1 of 2020 are disposed of.

Learned appropriate Trial Court as well as all concerned authorities shall act in terms of the copy of the order downloaded from the official website of this Court.
