Apzal Ansari .....For the Petitioner Ms. Faria Hossain Ms. Baisali Basu .....For the State Learned advocate appearing of the petitioner submits that the petitioner is 75 years old who has been falsely implicated in the case on the issue of landed dispute. It is pointed out that the accused person has married with a lady, the grandmother of the victim girl who had earlier married for thrice. Admittedly, the accused/petitioner is step grandfather of the victim girl. The case has been lodged at the instance of the mother of the victim girl.

I have heard learned advocate appearing for the petitioner and the State. My attention is invited particularly to the statement of the witnesses recorded at Page Nos.12, 13, 14, 15 of the Case Diary and also to Page No.42 being the statement of the victim girl recorded under Section 164 of the Criminal Procedure Code.

Having regard to the statement, so made by the victim girl, the prayer for bail, at this stage, is refused. Accordingly, CRM 6455 of 2020 is disposed of. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance of the requisite formalities.
