Bhattacharyya ... for the applicants Mr. Bidhan Biswas Mr. Pralash Bapari ... for the State Learned counsel appearing for the applicants submits that this application for modification and for extension of time so that the concerned BL&LRO can take an appropriate decision by passing a reasoned order. An order was passed with a direction upon the concerned BL&LRO on 28th April, 2015 to pass a reasoned order within three weeks from the date of communication of the above order and the order was communicated to the BL&LRO in the year 2015 but till date no order was communicated to the applicant.
The learned counsel prays for an extension of time with the direction upon the BL&LRO, Sutahata-II, Purba Midnapore to take an appropriate decision by passing a reasoned order within a specified time. The learned counsel further submits that an option may also be given by the BL&LRO as indicated in the order 28th April, 2015 to file return under Section 5A of Estate Acquisition Act at the time of hearing before the BL&LRO.
Learned counsel appearing for the State submits that the BL&LRO, Sutahata-II, Purba Midnapore is ready and willing to pass a reasoned order, if twelve weeks time is granted to the BL&LRO from the date of communication of this order. Heard learned counsel for the parties.
The BL&LRO, Sutahata-II, Purba Midnapore is requested to pass a reasoned order within eight weeks from the date of communication of this order and the reasoned order to be communicated to the applicants within two weeks thereafter. It is needless to mention that before giving an opportunity of hearing to the applicants/all successors of Big Rayat, the BL&LRO, Sutahata-II, Purba Midnapore shall accepts return filed under Section 5A of the Estate Acquisition Act. If the applicants/all successors of Big Rayat file the same before BL&LRO, the BL&LRO shall consider the return before the conclusion of proceeding.
With the above directions the RVW 186 of 2015 is disposed of.
