FMA 1621 of 2000 20-08-2025 The New India Assurance Co. Ltd.

Ct. 16 sg

Versus

Maya Rani Sahoo & Anr.

Mr. P.K. Pahari ...for the appellant Ms. Deblina Lahiri Mr. Mrinmoy Chatteree ...for the respondents 1.

We have heard the learned Counsel for the parties. The admitted amount has already been withdrawn by the claim. The challenge is essentially with regard to determination of compensation on the basis of age and wages multiplied by the relevant factor.

2.

The learned Trial Court has taken into consideration all the relevant factors including age and wages and the deprivation of earning by reason of death of the deceased in calculating the amount of compensation.

3.

On such consideration, we do not find that any substantial question of law is involved for admission of the appeal. The appeal stands dismissed.

4.

In view of the dismissal of the appeal, the remaining amount deposited with the Commissioner, Workman's Compensation, shall be released upon the claimant on proper identification within a period of two weeks from the date of communication of this order by either of the parties.
