28.11.2022 Srimanta Sl. No. 127 Ct. No. 238 IA No.:CAN/1/2020, CAN/2/2021 in WPA/7076/2020 Prof.(Dr.) Pankaj Kumar Mandal -Vs.- State of West Bengal & Ors.

Mr. Ajit Kumar Mishra, Mr. Indranuj Dutta, Adv., Mr. Bikram Basak, Adv., Mr. Abhishek Dey, Adv.

....for the petitioner.

Mr. Tapan Kumar Mukherjee, Adv., Ms. Tuli Sinha, Adv.

...for the State.

Mr. S. Panda, Adv., Mr. Sougata Mitra, Adv., Ms. Mithu Singha Mahapatra, Adv.

...for the Sidho Kanho Birsha University.

The petitioner participated in a selection proceeding for the post of Associate Professor of History at Sidho Kanho Birsha University under scheduled caste category.

Petitioner appeared before the Selection Committee, but he was found not suitable. The only point that has been urged on behalf of the petitioner to assail the selection process is that the Committee was not constituted properly by inclusion of a member from scheduled caste community.

The affidavit-in-opposition filed by the University discloses that one Mr. Manas Kabi was a member of the Selection Committee and he belonged to scheduled caste community.

Though it has been submitted by Mr. Ajit Kumar Mishra, learned Advocate for the petitioner that in the pleadings the names of the selectors have not been

disclosed, I have no reason to discard annexure- R/1 to the affidavit-in-opposition wherein the names of the members have been disclosed.

That being the position I do not find any substance in the writ petition.

Accordingly, WPA/7076/2020 is dismissed.
