The mother of the petitioner executed a deed of gift in respect of her property situated within the Chandanngore Municipal Corporation in his favour. The said deed of gift was subsequently cancelled in a proceeding initiated by the mother under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007.

The mother of the petitioner after cancellation of the said deed of gift, gifted the said property to the respondent no. 3 and who on the basis of the said deed of gift mutated his name in respect of the said property in the records of the Chandannnagore Municipal Corporation. The order annulling the said deed of gift was subsequently set aside in C.O No. 3988 of 2017. The petitioner thereafter applied before the Municipal Corporation for mutation of his name after

canceling the name of the respondent no. 3 in respect of the said property.

The petitioner complains that the said application has not yet attended by the Municipal Corporation. The learned Counsel appearing on behalf of the Commissioner, Chandannnagore Municipal Corporation being the respondent no. 1 herein submits that the Municipal Corporation shall dispose of the said application of the petitioner for mutation within four weeks. That being the stand of the respondent Municipal Corporation WPA 7079 of 2020 is disposed of by directing the respondent No. 1 herein to dispose of the application of the petitioner for mutation appearing at page 146 being Anexure "P-17" to the writ petition within four weeks after the puja vacation of the municipality, in accordance with law by a reasoned order, giving all interested parties an opportunity of being heard particularly the respondent no. 3 herein.

The connected application being CAN 1 of 2020 is disposed of accordingly.

There shall be no order as to costs.
