The petitioner responding to an advertisement bearing Memo No. 1068/C dated November 29, 2013 issued by the District Magistrate, Rampurhat, district :
Birbhum applied for the post of "ASHA" for Sonarkundu village within the Sub-division : Rampurhat, district : Birbhum.
The petitioner complains that the respondent no.11, Smt. Pratima Let who has been selected for the post is lacking the required qualification as she was not the voter of the area for which the vacancy has been declared.
The petitioner further complains that she has already submitted a representation to the
Sub-Divisional Officer, Rampurhat, distrist Birbhum ventilating her said grievance, but the same has not yet been taken care of.
W.P.A. 7081 of 2020 is disposed of by directing the Sub-Divisional Officer, Rampurhat, district : Birbhum being respondent no.5 herein to consider and dispose of the representation of the writ petitioner dated March 20, 2020 appearing at page '70' being Annexure "P-7" to the writ petition in accordance with law by a reasoned order after giving all the concerned parties an opportunity of hearing.
The connected application being CAN 1 of 2020 is also disposed of.
It is made clear that this Court has not gone into the merit of the claim of the writ petitioner, it is for the said respondent no.5 to decide the same.
It is expected that the respondent no.5 shall make all endeavour to dispose of the said representation of the petitioner expeditiously. There will be no order for costs.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
