1. This instant criminal appeal is filed by the accused/appellant against an order of conviction under Section 376 of the Indian Penal Code and sentenced to suffer Rigorous Imprisonment for six years and to pay a fine of Rs.5,000/- in default, to suffer Rigorous Imprisonment for six months, which was passed by the learned Additional Sessions Judge, 2nd Court, Midnapore by the judgment and order dated 20th August, 1993 in Sessions Trial Case No.II of July, 1992.

2. In this case, the direction was given to serve the Administrative Notice upon the appellant.

3. In terms of the same, the notice was issued and a report has been furnished before this Court as forwarded by the learned A.C.J.M, Contai, Purba Midnapore, which reveals that the sole appellant/Molin Maity @ Prankrishna Maity has expired on 14th December, 2021 and the death certificate to that extent is annexed with the report.

4. I have perused the death certificate, which also confirms the said fact.

5. Since, the sole appellant expired, the instant appeal cannot be proceeded with and the appeal stands abated.

6. In view of the above, the criminal appeal being, C.R.A. 214 of 1993 stands disposed of being abated.

7. All parties shall act on the server copies of this order duly downloaded from the official website of this Court.
