Learned advocate appearing for the petitioner submits that the petitioner is a senior citizen. His only son and daughter-in-law are making life miserable for the petitioner. The petitioner seeks eviction of such private respondents from the property owned by him.
State is represented.
Learned advocate appearing for the State submits that the complaint was enquired into and a prosecution under Section 107 of the Code of Criminal Procedure.
The petitioner is a senior citizen. Petitioner may approach the Tribunal under the provisions of the Maintenance and Welfare of Parents and Senior
Citizens Act, 2007 for relief. A Writ Court need not enter into the arena of evicting the private respondents from the property belonging to a private citizen.
Accordingly, the writ application being WPA 7086 of 2020 is disposed of.
In view of disposal of the main writ petition, connected application being CAN 1 of 2020 is also disposed of.
