It is submitted on behalf of the respondents that, a copy of the affidavit-in-opposition was sought to be served upon the learned advocate for the petitioner, who refused to accept the same.

In such circumstances, since copy affidavit was tendered and refused no further copy of the affidavit-inopposition need be served on the petitioner. Learned advocate for the petitioner seeks time to

file affidavit-in-reply. Such prayer is considered and refused. Such prayer is made to delay disposal of the proceeding. Learned advocate for the petitioner is requested to proceed with the matter.

Learned advocate for the petitioner seeks review of the order dated August 16, 2019 disposing of the contempt rule.

According to the petitioner, the Railways did not pay the retiral dues of the petitioner. The order dated August 16, 2019, the review of which sought for herein records that, the Railways make payment to the petitioner. It proceeds to record that, according to the petitioner, payment so made are not complete payment. The order proceeds to record another fact. It records that, the petitioner may or may not be aggrieved to the quantum of payment. In such factual background, the contempt rule was disposed of. The review petition is firvolous, vexatious and should be appropriately dealt with. The Railway Authority will ensure that a cost of Rs. 10,000/- is realised from the petitioner and deposited with the West Bengal State Legal Services Authority within a fortnight from date. The review application being RVW 233 of 2019

along with CAN 1 of 2019 (Old CAN No. 10530 of 2019) are disposed of accordingly.
