1. CAN 1 of 2023 is filed seeking recall of the order dated 21st August, 2023.

2. Sufficient grounds are available to explain the absence of the appellant and/or her Counsel on 21st August, 2023 before this Court.

3. The said order is recalled and the appeal is restored to its file and number.

4. Accordingly, the application being CAN 1 of 2023 shall stand disposed of.

5. There will be, however, no order as to costs. Re: F.A. No.17 of 2000

1. Counsel for the appellant has filed instructions dated 19th February, 2023 signed by the appellant herself claiming that the disputes between the appellant and the respondents have been amicably settled and she wants to withdraw the instant appeal.

2. In that view of the matter, F.A. No. 17 of 2000 shall stand dismissed as withdrawn.

3. The written instructions dated 19th February, 2023 addressed by the appellant to her Advocate, Mr. Sayan Kanjilal is kept with the record.

4. Interim order, if any, shall stand vacated.

5. There will be no order as to costs.
